Terms and Conditions

These terms and conditions (“Booking Terms”) are applicable and binding on any user/visitor/prospective customer (individual user or company/firm) (“User” or “You” or “Your”) of Josh Electric , who accesses or uses https://joshelectric.in/  to make the booking amount payment in accordance with the model of Josh Electric.

Kindly read and understand these Booking Terms carefully. If these Booking Terms are not acceptable to you or you are not eligible to accept these Booking Terms or book the Scooter under applicable laws, please do not proceed with the booking. To the extent applicable, you hereby give your consent to receiving marketing and/or promotional communications from us through all communication channels including but not limited to SMS, WhatsApp, e-mails and push notifications.

TERMS AND CONDITIONS

The User hereby agrees, acknowledges and confirms that the User is: (i) a holder of a valid driving license issued under the Motor Vehicles Act, 1988; (ii) not prohibited from owning a vehicle in the jurisdiction of purchase; (iii) the Josh Electric (model and color) and dealership details (“Dealership”) are as per the selection of the User; (iv) can understand, read and write in the English language; and (v) has read, understood and agrees to be bound by these clickable Terms.

The User acknowledges the images and colors on the Platform are representation of the actual Josh Electric. Josh Electric has taken every effort to make a true representation. However, the actual images and color depend on the purchased vehicle of the User and cannot be guaranteed by Josh Electric.

If the User is booking or purchasing on behalf of another person, the necessary detail of such other person is required to be mentioned and the requisite details of such other person are required to be produced at the Dealership.

The User agrees and confirms that the below information shared by the User on the Platform for booking of the Josh Electric is true and accurate:

Full Name, Mobile No, Email Address, and City.

The User agrees and understands that these details as provided by the User would be used by Josh Electric and the Dealership to communicate with the User.

All formalities with respect to the purchase of the Josh Electric, including but not limited to the registration process shall be performed at the respective dealership. The sale and delivery of the Josh Electric shall be subject to fulfilment of all applicable statutory obligations and submission of requisite supporting documents. The originals of these documents will need to be produced at the dealership. In the event of the user’s failure to ensure compliance with these requirements, the booking or purchasing amount paid by the user is liable to be forfeited. The user warrants that the user has the required documents.

ACCEPTANCE OF BOOKING

On completion of payment of the booking amount in accordance with:

User would be required to complete the subsequent formalities and process of submitting their Aadhaar Card, PAN Card and address proof (carry both original and copies of all documentation for verification) and make payment of the remaining amount at the Dealership at the earliest, after being informed by the Dealer to the User.

BOOKING TERMS

Our Josh Electric retains the right to revise the specification, standard fitment and/or accessories of/for the Josh Electric or introduce new variants or their versions or discontinue earlier variants or versions.

Josh Electric will not be responsible for any delay, loss or non-receipt of online booking information or any other form of submission not contemplated herein Josh Electric reserves the right to change the Dealership for the purpose of sale and delivery of the Josh Electric as selected by the User and the same shall be communicated to the User through email/message.

The waiting period and the expected delivery slot communicated by Josh Electric at the time of pre-booking are tentative and are subject to change owing to various factors.

CANCELLATION POLICY

Booking cannot be cancelled after the delivery date has been communicated to the “User” by “Josh Electric”/” Dealer”. However, if the user wishes to cancel the booking, the user can do the same within 14 days (2 weeks) before the delivery date. The booking amount, as applicable, will be refunded net of transaction charges of 5% to the same account from where the booking was generated. Cancellation request, if any, should be requested through his account on  https://joshelectric.in/ .

The booking amount shall be refunded to the User through the same mode that was used for making the payment of the booking amount. It may take 4 to 6 weeks for the amount to be refunded. No cash payments would be made by Dealership or Josh Electric to the User.

Please note, no changes and/or modification are allowed online for the Josh Electric after the booking amount has been paid and the booking has been made. For any change/modification, the existing booking is to be cancelled and a fresh booking is required to be made.

Please note there shall be no interest payable by Josh Electric or the dealership for any repayment against cancellations made in accordance with these terms.

COMMUNICATION

The User agrees, understands, and acknowledges that the transmission of information through internet is not a secure means of sending information and the same may be subject to tampering and unauthorized access, fraudulently or mistakenly written, altered or sent, and not be received in whole or in part by the intended recipient and which may affect the availability and performance of this online facility provided by Josh Electric. Accordingly, the User shall not hold Josh Electric liable for any loss/damage, whether direct or indirect, arising out of or resulting from such tampering and unauthorized access, frauds, mistakes, etc.

The User authorizes Josh Electric to exchange or share information and details relating to the User’s booking of the Josh Electric to the Dealership, Josh Electric group companies and other third-party agents/representatives as may be required or as it may deem fit for the purpose of facilitating the booking and/or related offerings or other products/services that the User may apply for from time to time. The User agrees and confirms that the User shall not hold Josh Electric (or any of its group companies or its/their agents/representatives) liable for use/sharing of such information.

The User understands that by sharing the User’s contact information, the User hereby provides consent for receiving communications from Josh Electric, its group companies, agents/ representatives in relation to the Josh Electric including promotional communications through any mode (including without limitation through telephone calls/SMSs/WhatsApp/Emails). The User confirms that the User shall not challenge receipt of such communications as unsolicited communication, defined under TRAI Regulations on Unsolicited Commercial Communications.

The User understands and undertakes to keep the User’s credentials including order details/ booking information, as confidential and shall not share the same with any third party. Any use or misuse of the same including the transactions carried shall be the sole responsibility of the User and Josh Electric shall not be held responsible for any loss/damage incurred on account of such use, misuse and/or transactions.

All parties shall ensure the compliance of the applicable provisions of the Information Technology Act, 2000 and its allied rules as amended from time to time.

GENERAL TERMS

Also, as per the Government Regulations, to avail the benefit of the subsidy under Phase II of the Faster Adoption and Manufacturing of Hybrid and Electric Vehicles (FAME II), Aadhaar Card is mandatory. The Aadhar card submitted can be used only once to avail a FAME II subsidy, if the subsidy had been availed in the past, the User shall not be eligible.

Josh Electric reserves the right to alter/change the terms and conditions of the process/ offer without prior notice at its sole discretion as and when considered necessary.

In case of any dispute, inconvenience or loss occurs due to User negligence, non-compliance or breach of applicable law, the User agrees to indemnify Josh Electric. the lending partner and the Dealership.

In the case of non-individual User, delivery would be made to the same authorized signatory, who booked the Josh Electric.

User agrees to defend, indemnify and hold Josh Electric harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to User’s use of the Platform.

Unless otherwise specified, the platform and its contents thereof are displayed solely for the purpose of promoting Josh Electric products and services.

In case of any dispute relating to the transaction or any other matter arising for use of this Platform for the purpose of booking, the same will be subject to the exclusive jurisdiction of the appropriate Court at Jablabpur, Madhya Pradesh.

Josh Electric reserves the right to amend these Terms and/ or withdraw or discontinue the online booking service without prior notice.

Non-acceptance of any of these terms and conditions will result in disqualification.

The offer to make a booking of the Josh Electric subject to these terms and conditions is optional and the User may choose not to book the Josh Electric in response to the offer.
